Terms of Service

Welcome to MindBucket. These Terms of Service ("Terms") govern your use of the MindBucket application and website at mindbucket.ai (the "Service"), operated by Blue Compass Software LLC ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who we are

The Service is provided by Blue Compass Software LLC, a limited liability company organized under the laws of the State of New Jersey, United States. You can contact us at sbersey@bluecompasssoftware.com.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements.

3. Your account

To use the Service you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it current. Notify us promptly of any unauthorized use of your account.

4. The Service

MindBucket is a web-based mind-mapping tool that lets you create, organize, edit, and store visual diagrams ("Diagrams"), along with attachments such as notes, files, checklists, and transcribed audio that you associate with your Diagrams ("Content"). We may add, modify, or remove features over time.

6. Payments and billing

Payments for the Pro subscription are processed by our authorized reseller and Merchant of Record, Paddle.com Market Limited ("Paddle"). When you purchase a subscription, your contract for the paid product is with Paddle, and Paddle's buyer terms also apply to that transaction. Paddle handles payment processing, billing, invoicing, and applicable sales tax/VAT collection on our behalf.

Subscriptions renew automatically at the then-current price each billing period unless cancelled before the renewal date. You authorize Paddle to charge your payment method on a recurring basis until you cancel.

7. Cancellation

You may cancel your Pro subscription at any time through the billing portal accessible within the app. When you cancel, your subscription remains active until the end of the current paid billing period, after which it will not renew and your account will revert to free (view-only) access. 8. Account deletion

You may delete your account at any time from within the app. Deleting your account permanently removes your Diagrams, attachments, and account data, and immediately cancels any active subscription without refund for the remaining period. Deletion is irreversible. You may also request deletion by contacting us at sbersey@bluecompasssoftware.com.

9. Your Content

You retain all ownership rights to the Content you create and store in the Service. You grant us a limited license to store, process, and display your Content solely as necessary to provide the Service to you. We do not claim ownership of your Content and we do not sell it. You are solely responsible for your Content and for ensuring you have the right to store and use it.

11. Intellectual property

The Service, including its software, design, and branding, is owned by Blue Compass Software LLC and is protected by intellectual property laws. These Terms do not grant you any right to our trademarks, logos, or other brand features.

12. Service availability

We strive to keep the Service available and reliable, but we provide it on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or that Content will never be lost. We recommend keeping your own backups of important Content.

13. Disclaimers

To the maximum extent permitted by law, the Service is provided without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of liability

To the maximum extent permitted by law, Blue Compass Software LLC and its members, officers, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue, arising out of or related to your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the amount you paid us in the twelve (12) months preceding the claim.

15. Indemnification

You agree to indemnify and hold harmless Blue Compass Software LLC from any claims, damages, or expenses arising from your Content, your use of the Service, or your violation of these Terms.

16. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

17. Governing law

These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-law principles. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in New Jersey, except where prohibited by applicable law.
